The Rise of the Fourth Branch of Government


Below is today’s column in the Washington Post’s Outlook Section on the dangers of America’s growing administrative state. Ask any elementary student and you will hear how the Framers carefully designed a tripartite, or three-branch, system to govern the United States. This separation of powers was meant to protect citizens from tyranny by making every branch dependent on each other to carry out the functions of government. These three branches held together through a type of outward pressure – each holding the other in place through their countervailing forces. Add a fourth branch and the structure begins to collapse. That is precisely what is happening as federal agencies grow beyond the traditional controls and oversight of the legislative and executive branches. The question is how a tripartite system can function as a quadripartite system. The answer, as demonstrated by the last two decades, is not well. The shift from a tripartite to a quadripartite system is not the result of simply the growth in the size of the government. Rather, it is a concern with the degree of independence and autonomy in the fourth branch that led me to write this column.

There were times this past week when it seemed like the 19th-century Know-Nothing Party had returned to Washington. President Obama insisted he knew nothing about major decisions in the State Department, or the Justice Department, or the Internal Revenue Service. The heads of those agencies, in turn, insisted they knew nothing about major decisions by their subordinates. It was as if the government functioned by some hidden hand.

Clearly, there was a degree of willful blindness in these claims. However, the suggestion that someone, even the president, is in control of today’s government may be an illusion.

The growing dominance of the federal government over the states has obscured more fundamental changes within the federal government itself: It is not just bigger, it is dangerously off kilter. Our carefully constructed system of checks and balances is being negated by the rise of a fourth branch, an administrative state of sprawling departments and agencies that govern with increasing autonomy and decreasing transparency.

When James Madison and the other Framers fashioned a new constitutional structure in the wake of the failure of the Articles of Confederation they envisioned a vastly different government. Under the federalism model, states would be the dominant system with most of the revenue and responsibilities of governance. The federal government was virtually microsoptic by today’s standards. In 1790, it had just 1,000 nonmilitary workers. In 1962, there were 2,515,000 federal employees. Today, we have 2,840,000 federal workers in 15 departments, 69 agencies and 383 nonmilitary sub-agencies.  [These numbers can be themselves misleading since much federal work is now done by contractors as part of "downsizing" but the work of the agencies has continued to expand.  Moreover, technological advances have increased the reach of this workforce].

This  growth since the founding has led to increasing power and independence for agencies. The shift of authority has been staggering. The fourth branch now has a larger practical impact on the lives of citizens than all the other branches combined.

The rise of the fourth branch has been at the expense of Congress’s lawmaking authority. In fact, the vast majority of “laws” governing the United States are not passed by Congress but are issued as regulations, crafted largely by thousands of unnamed, unreachable bureaucrats. One study found that in 2007, Congress enacted 138 public laws, while federal agencies finalized 2,926 rules, including 61 major regulations.

This rulemaking comes with little accountability. It’s often impossible to know, absent a major scandal, whom to blame for rules that are abusive or nonsensical. Of course, agencies owe their creation and underlying legal authority to Congress, and Congress holds the purse strings. But Capitol Hill’s relatively small staff is incapable of exerting oversight on more than a small percentage of agency actions. And the threat of cutting funds is a blunt instrument to control a massive administrative state — like running a locomotive with an on/off switch.

The autonomy was magnified when the Supreme Court ruled in 1984 that agencies are entitled to heavy deference in their interpretations of laws. The court went even further this past week, ruling that agencies should get the same heavy deference in determining their own jurisdictions — a power that was previously believed to rest with Congress. In his dissent in Arlington v. FCC, Chief Justice John Roberts warned: “It would be a bit much to describe the result as ‘the very definition of tyranny,’ but the danger posed by the growing power of the administrative state cannot be dismissed.”
The judiciary, too, has seen its authority diminished by the rise of the fourth branch. Under Article III of the Constitution, citizens facing charges and fines are entitled to due process in our court system. As the number of federal regulations increased, however, Congress decided to relieve the judiciary of most regulatory cases and create administrative courts tied to individual agencies. The result is that a citizen is 10 times more likely to be tried by an agency than by an actual court. In a given year, federal judges conduct roughly 95,000 adjudicatory proceedings, including trials, while federal agencies complete more than 939,000.

These agency proceedings are often mockeries of due process, with one-sided presumptions and procedural rules favoring the agency. And agencies increasingly seem to chafe at being denied their judicial authority. Just ask John E. Brennan. Brennan, a 50-year-old technology consultant, was charged with disorderly conduct and indecent exposure when he stripped at Portland International Airport last year in protest of invasive security measures by the Transportation Security Administration. He was cleared by a trial judge, who ruled that his stripping was a form of free speech. The TSA was undeterred. After the ruling, it pulled Brennan into its own agency courts under administrative charges.

The rise of the fourth branch has occurred alongside an unprecedented increase in presidential powers — from the power to determine when to go to war to the power to decide when it’s reasonable to vaporize a U.S. citizen in a drone strike. In this new order, information is jealously guarded and transparency has declined sharply. That trend, in turn, has given the fourth branch even greater insularity and independence. When Congress tries to respond to cases of agency abuse, it often finds officials walled off by claims of expanding executive privilege.

Of course, federal agencies officially report to the White House under the umbrella of the executive branch. But in practice, the agencies have evolved into largely independent entities over which the president has very limited control. Only 1 percent of federal positions are filled by political appointees, as opposed to career officials, and on average appointees serve only two years. At an individual level, career officials are insulated from political pressure by civil service rules. There are also entire agencies — including the Securities and Exchange Commission, the Federal Trade Commission and the Federal Communications Commission — that are protected from White House interference.

Some agencies have gone so far as to refuse to comply with presidential orders. For example, in 1992 President George H.W. Bush ordered the U.S. Postal Service to withdraw a lawsuit against the Postal Rate Commission, and he threatened to sack members of the Postal Service’s Board of Governors who denied him. The courts ruled in favor of the independence of the agency.
It’s a small percentage of agency matters that rise to the level of presidential notice. The rest remain the sole concern of agency discretion.

As the power of the fourth branch has grown, conflicts between the other branches have become more acute. There is no better example than the fights over presidential appointments.
Wielding its power to confirm, block or deny nominees is one of the few remaining ways Congress can influence agency policy and get a window into agency activity. Nominations now commonly trigger congressional demands for explanations of agencies’ decisions and disclosures of their documents. And that commonly leads to standoffs with the White House.

Take the fight over Richard Cordray, nominated to serve as the first director of the Consumer Financial Protection Bureau. Cordray is highly qualified, but Republican senators oppose the independence of the new bureau and have questions about its jurisdiction and funding. After those senators repeatedly blocked the nomination, Obama used a congressional break in January to make a recess appointment. Since then, two federal appeals courts have ruled that Obama’s recess appointments violated the Constitution and usurped congressional authority. While the fight continues in the Senate, the Obama administration has appealed to the Supreme Court.
It would be a mistake to dismiss such conflicts as products of our dysfunctional, partisan times. Today’s political divisions are mild compared with those in the early republic, as when President Thomas Jefferson described his predecessor’s tenure as “the reign of the witches.” Rather, today’s confrontations reflect the serious imbalance in the system.

The marginalization Congress feels is magnified for citizens, who are routinely pulled into the vortex of an administrative state that allows little challenge or appeal. The IRS scandal is the rare case in which internal agency priorities are forced into the public eye. Most of the time, such internal policies are hidden from public view and congressional oversight. While public participation in the promulgation of new regulations is allowed, and often required, the process is generally perfunctory and dismissive.

In the new regulatory age, presidents and Congress can still change the government’s priorities, but the agencies effectively run the show based on their interpretations and discretion. The rise of this fourth branch represents perhaps the single greatest change in our system of government since the founding.

We cannot long protect liberty if our leaders continue to act like mere bystanders to the work of government.

Conservatives Beat Obama's #My2K Hashtag



President Obama asked Americans on Wednesday to tweet what they would do with an extra $2,000 that would come from a proposed extension of current tax cuts for middle-income households, with the hashtag #My2K.  
“Call your members of Congress. Write them an email. Tweet it using the hashtag #My2K.” —President Obama
There is already a coordinated effort by the left to rally behind this publicity stunt.

By the way, the savvy communications team at The Heritage Foundation got ahead of the game and bought the promoted tweet for the #My2K hashtag when they learned about the White House plans that morning.

Heritage’s tweet directed those on Twitter to a blog post at the think tank’s site (“4 Reasons Warren Buffett is Wrong on Tax Hikes“)

We ask that all American citizens read and consider this document. We ask that each recognizes it is now our moment in history to act for peaceful restoration of our country. We ask that American citizens do their patriotic duty to preserve and protect the Constitution of these United Sates.

Please distribute this document by any and all available means. This must reach our state capital buildings, our US Senators and Representatives, all of our news and media outlets, our political party headquarters, our White House and every American citizen. Please email, copy and hand out to everyone you meet, mail it and talk with others about this. Saving America is our duty and the time is now. This effort requires the support and action of millions who care. Please help us before this moment and our nation is lost.


America was founded as a nation of laws, the basis of these laws were framed within our Constitution. Our birthright as Americans is the power to select our leaders who then rule with our consent. It is the duty and obligation of all leaders to prove their eligibility to attain their position. It is also the duty of these leaders to function within the framework of our Constitution which provides 3 co-equal branches of government. No office can supersede another co-equal branch or assume powers not delegated by the Constitution. We were guaranteed the right to choose leaders. We were guaranteed the right to representative government. We are guaranteed the right to replace leadership. We believe that when leaders fail to adhere to our Constitution and fundamental values we have the inalienable right to demand that these leaders resign their positions. American leaders rule by consent but that consent must be maintained and is not to be ignored once an office or position is obtained. No position in American government should be secure when removal of an elected official is demanded by a solid, vocal majority of American voters. Our government is selected by us to serve us. We demand that this concept remain as our right.

July 4th, 2010 shall be recorded in history as the day that Americans set forth to demand the resignation of President Barack Hussein Obama. We believe that Mr. Obama has failed in his duty and obligations as Chief Executive representing the American People. We believe that the actions and lack of actions of Mr. Obama's service have damaged our nation and will further diminish our nation, our security, our economy and our future prosperity. We believe that it is now our patriotic duty to demand that Mr. Obama resign from the Presidency of the United States of America effective immediately. We believe it is the duty of Mr. Obama to recognize the desires of American citizens and the best interests of the nation and resign as a matter of honor. We believe Mr. Obama has violated his oath of office and is no longer is capable of serving as President with the confidence and consent of the American People. To remain in office is to rule without consent, this is not how America is governed and we retain the right to ask for the resignation of any failed leader.

We list the following complaints as the evidence to support our demands:
1.Mr. Obama has failed to prove beyond all reasonable doubt his eligibility by birth to serve as President of the United States.

2.Mr Obama has failed his Presidential Oath of Office by failing to protect and defend the United States against all enemies foreign and domestic.

3.Mr. Obama has failed to make an effort to protect the citizens of our nation against the invasion of illegal immigrants from a variety of nations through our unsecured southern border. Criminal invaders are known to pass through these borders routinely and it is the duty of the President to prevent this.

4.Mr. Obama has appointed a large number of “Czars” who are then funded and allowed to influence controls over citizens who are not able to elect or reject these un-Constitutional leaders.

5.Mr. Obama has failed in the management of the Gulf of Mexico oil disaster and is using the tragedy to implement regulations and penalties beyond his Constitutional authority.

6.Mr. Obama is actively destroying the economy of the Gulf region by imposing crippling industry controls beyond his Constitutional powers.

7.Mr. Obama is implementing policies that will raise gasoline and fuel prices to levels that will undermine the economy and damage the personal finances of a majority of United States citizens.

8.Mr. Obama is actively interfering with the power of several state governments and their ability to act in the best interests of their citizens. In particular this refers to the Gulf region citizens and those in Arizona who seek only to secure the safety and security of their homes, businesses and economies.

9.Mr. Obama has repeatedly insulted or abandoned long term and valued United States trade and military allies including denying defensive weapons and installations.

10.Mr. Obama has contributed to de-stabilization of the Middle East by failing to continue our tradition of support for Israel.

11.Mr. Obama has contributed to de-stabilizing the Middle East by failing to take strong actions to prevent the development of nuclear arms by the nation of Iran.

12.Mr. Obama threatens the future prosperity of the United Sates by continuing record levels of deficit spending.

13.Mr. Obama has violated our Constitution and his Oath of Office by seizing federal control of privately owned banks, insurance companies and auto-makers

14.Mr. Obama, with the aid of Congress, has succeeded in establishing a new model for the management of health care in this nation that is now demonstrated to violate every cost projection and coverage guarantee that is was promised to ensure.

15.Mr. Obama has lost the confidence of the American people by failing to adequately and effectively address serious national issues while maintaining a vigorous entertainment and personal schedule.

We believe that each day of failed Presidential leadership represents a clear and present danger to our nation. We believe that continuing the current White House management and policies leaves our nation vulnerable to international enemies, at risk of extreme financial damage, imminent destruction of our Gulf economy and eco-system, and subject to unsustainable national debt for generations to come.

This list of charges and statements is not complete but we believe it is absolutely sufficient to justify the demand for President Barack Hussein Obama to immediately resign from office as the President of the United States of America. We will continue to demand this. We pledge to gather support of an increasingly large and vocal majority until this demand is met.

"TRAGEDY AT FT HOOD" A LETTER BY LT COL ALLEN WEST

“Tragedy at Ft Hood”

This past Thursday 13 American Soldiers were killed and another 30 wounded at a horrific mass shooting at US Army installation, Ft Hood Texas. As I watched in horror and then anger I recalled my two years of final service in the Army as a Battalion Commander at Ft Hood, 2002-2004.


My wife and two daughters were stunned at the incident having lived on the post in family housing.


A military installation, whether it is Army, Navy, Air Force, Marine, or Coast Guard, is supposed to be a safe sanctuary for our Warriors and their families. It is intended to provide a home whereby our “Band of Brothers and Sisters” can find solace and bond beyond just the foxhole but as family units.


A military installation is supposed to be a place where our Warriors train for war, to serve and protect our Nation.


On Thursday, 5 November 2009 Ft Hood became a part of the battlefield in the war against Islamic totalitarianism and state sponsored terrorism.


There may be those who feel threatened by my words and would even recommend they not be uttered. To those individuals I say step aside because now is not the time for cowardice. Our Country has become so paralyzed by political correctness that we have allowed a vile and determined enemy to breach what should be the safest place in America, an Army post.


We have become so politically correct that our media is more concerned about the stress of the shooter, Major Nidal Malik Hasan. The misplaced benevolence intending to portray him as a victim is despicable. The fact that there are some who have now created an entire new classification called; “pre-virtual vicarious Post Traumatic Stress Disorder (PTSD)” is unconscionable.


This is not a “man caused disaster”. It is what it is, an Islamic jihadist attack.


We have seen this before in 2003 when a SGT Hasan of the 101st Airborne Division (Air Assault) threw hand grenades and opened fire into his Commanding Officer’s tent in Kuwait. We have seen the foiled attempt of Albanian Muslims who sought to attack Ft Dix, NJ. Recently we saw a young convert to Islam named Carlos Bledsoe travel to Yemen, receive terrorist training, and return to gun down two US Soldiers at a Little Rock, Arkansas Army recruiting station. We thwarted another Islamic terrorist plot in North Carolina which had US Marine Corps Base, Quantico as a target. What have we done with all these prevalent trends? Nothing.


What we see are recalcitrant leaders who are refusing to confront the issue, Islamic terrorist infiltration into America, and possibly further into our Armed Services. Instead we have a multiculturalism and diversity syndrome on steroids.


Major Hasan should have never been transferred to Ft Hood, matter of fact he should have been Chaptered from the Army. His previous statements, poor evaluation reports, and the fact that the FBI had him under investigation for jihadist website posting should have been proof positive.


However, what we have is a typical liberal approach to find a victim, not the 13 and 30 Soldiers and Civilian, but rather the poor shooter. A shooter who we are told was a great American, who loved the Army and serving his Nation and the Council on American Islamic Relations (CAIR) stating that his actions had nothing to do with religious belief.


We know that Major Hasan deliberately planned this episode; he did give away his possessions. He stood atop a table in the confined space of the Soldier Readiness Center shouting “Allahu Akhbar”, same chant as the 9-11 terrorists and those we fight against overseas in the Iraq and Afghanistan theaters of operation.


No one in leadership seems willing to sound the alarm for the American people; they are therefore complicit in any future attacks. Our Congress should suspend the insidious action to vote on a preposterous and unconstitutional healthcare bill and resolve the issue of “protecting the American people”.


The recent incidents in Dearborn Michigan, Boston Massachusetts, Dallas Texas, and Chicago Illinois should bear witness to the fact that we have an Islamic terrorism issue in America. And don’t have CAIR call me and try to issue a vanilla press statement; they are an illegitimate terrorist associated organization which should be disbanded.


We have Saudi Arabia funding close to 80% of the mosques in the United States, one right here in South Florida, Pompano Beach. Are we building churches and synagogues in Saudi Arabia? Are “Kaffirs” and “” allowed travel to Mecca?


So much for peaceful coexistence.


Saudi Arabia is sponsoring radical Imams who enter into our prisons and convert young men into a virulent Wahabbist ideology….one resulting in four individuals wanting to destroy synagogues in New York with plastic explosives. Thank God the explosives were dummy. They are sponsoring textbooks which present Islamic centric revisionist history in our schools.


We must recognize that there is an urgent need to separate the theo-political radical Islamic ideology out of our American society. We must begin to demand surveillance of suspected Imams and mosques that are spreading hate and preaching the overthrow of our Constitutional Republic……that speech is not protected under First Amendment, it is sedition and if done by an American treason.


There should not be some 30 Islamic terrorist training camps in America that has nothing to do with First Amendment, Freedom of Religion. The Saudis are not our friends and any American political figure who believes such is delusional.


When tolerance becomes a one way street it certainly leads to cultural suicide. We are on that street. Liberals cannot be trusted to defend our Republic, because their sympathies obviously lie with their perceived victim, Major Nidal Malik Hasan.


I make no apologies for these words, and anyone angered by them, please, go to Ft Hood and look into the eyes of the real victims. The tragedy at Ft Hood Texas did not have to happen. Consider now the feelings of those there and on every military installation in the world. Consider the feelings of the Warriors deployed into combat zones who now are concerned that their loved ones at home are in a combat zone.


Ft Hood suffered an Islamic jihadist attack, stop the denial, and realize a simple point.


The reality of your enemy must become your own.

This man is right on...after receiving this letter, I did some research on him and was jumping for joy to see someone actually speaking the truth. He is running for Congress in Fla and in my estimation looks like a potential Presidential candidate for the future. He is just what our country needs. Now if we can find and elect about 500 more like him, we can take back this country from the ACLU and the Socialist party.
